This Copyright Statement applies to all digital design files, models, images, and instructions (collectively, "Projects") uploaded by Users ("Creators") on Atomm, including Free Projects and Premium Projects.
In this digital age, protecting creativity is more important than ever. Please read this Copyright Statement carefully before uploading, downloading, or using any Projects.
1. Definitions
1.1 The Platform, Users, and Projects
- Atomm / The Platform: Refers to the website, services, and applications provided by Makeblock Europe B.V.
- User: Any individual or entity accessing or using the Platform, including Creators, Reusers, and Purchasing Users.
- Creator: A User who uploads Projects to the Platform.
- Reuser: A User who downloads or accesses Free Projects.
- Purchasing User / Licensee: A User who legally purchases or gains paid access to a Premium Project.
- Project: Refers to all digital design files, models, images, and instructions uploaded to the Platform, categorized as either Free Projects or Premium Projects.
1.2 Core Project Files and Outputs
- Core Project Files: Means the primary digital files essential for fabrication, including, without limitation: SVG, DXF, EPS, PDF, AI, PSD, PNG, STL, OBJ files, cutting paths, engraving paths, G-codes, vector contours, outlines, model structures, production-ready templates, or toolpaths.
- Premium Project: A Project available for paid download, subscription, or paid license access.
- Physical Finished Products: Refers exclusively to the tangible, physical objects produced by the Licensee using the Core Project Files with digital fabrication tools.
- Modified Digital Version: Any derivative of the Core Project Files resulting from adaptation, remixing, scaling, format conversion, or combining with other elements.
2. Rights Granted to Atomm (Platform License)
By uploading any Project (including Free and Premium Projects), the Creator grants Atomm a worldwide, nonexclusive, transferable, sublicensable license to:
- host, store, reproduce, transmit, publicly display, promote, market, and distribute the Project
- make it available for paid download or subscription
- use it in advertising and marketing for the Platform
- enforce the license terms on behalf of the Creator
This license to Atomm is perpetual and remains valid to enable the continued use of the Project by the Licensee in accordance with the specific license granted to them, even if the Creator later removes the Project from the Platform.
3. Obligation of Creators
By uploading a Project, Creator represents and warrants that:
- the Project is entirely original or the Creator has full rights to license it;
- it does not infringe any copyright, trademark, publicity, moral, or other rights;
- it contains no third-party licensed content unless Creator strictly adheres to all terms of that third-party license (e.g., attribution, share-alike) and that content is permitted for commercial licensing;
- the Creator is legally able to grant this commercial license;
- the license terms selected are valid and enforceable;
- the Project is technically functional for its intended purpose (e.g., closed vectors for cutting, manifold geometry for printing). Uploading unverified or technically broken files that cause material waste is prohibited.
Creators agree to indemnify Atomm and all Purchasing Users against claims arising from any breach of this representation.
AI-Generated Content (AIGC) Policy
To protect the ecosystem, strictly regulated rules apply to AI usage:
- Mandatory Disclosure: If a Project's core design files (e.g., vectors, 3D models), or the functional instructions required for fabrication, are created partially or wholly using Generative AI tools (e.g., Midjourney, ChatGPT, AImake), the Creator MUST clearly label the Project as "AI-Assisted" upon uploading.[Exclusion] Notwithstanding the foregoing, AI usage strictly limited to generating or enhancing promotional images, cover art, or thumbnails that serve solely as marketing material for the Project shall NOT trigger this mandatory disclosure requirement, provided such AI use does not alter the intellectual property, structural integrity, or fabrication files of the Project itself.
- Premium Project Standard: For Premium Projects, Creator warrants that the Project is NOT a raw, unmodified AI output. It must contain substantial human creative input and manual editing to qualify for copyright protection.
- Indemnification: Creator assumes full liability for any copyright disputes arising from their use of AI tools and agrees to indemnify Atomm against related claims.
Consequences of Infringement & Financial Liability
Creators acknowledge that Atomm acts as a trusted marketplace. If a Project is found to be infringing, plagiarized, or technically defective:
- Right to Freeze: We may freeze your earnings immediately upon receipt of a credible copyright complaint.
- Right to Refund & Recover: We will refund the affected buyers. You agree that we may deduct these refunded amounts from your current or future earnings ("Clawback").
- Account Termination: We reserve the right to ban accounts involved in IP theft and withhold remaining funds to cover disputes and legal costs.
4. Terms of License
Atomm offers two distinct categories of licensing. The specific license applies as selected by the Creator and will be shown on each Project.
A. For Free Projects
For Free Projects, the Creator grants other Users ("Reusers") an irrevocable, non-exclusive, worldwide license subject to the specific terms below:
Standard Digital File License (S-D-F-L)
- Permitted: Reuser may access, download, and use the Project to produce physical items for Personal and Non-Commercial Use only.
- Prohibited: Reuser shall NOT share, sub-license, sell, rent, or distribute the Project or its derivative works (digital or physical) for profit. Reuser may not upload the Project to other cloud repositories or web stores.
Creative Commons Licenses
- CC BY 4.0: This license enables Reusers to distribute, remix, adapt, and build upon the project in any medium or format, so long as attribution is given to the Creator. The license allows for commercial use.
- CC BY-SA 4.0: This license enables Reusers to distribute, remix, adapt, and build upon the project in any medium or format, so long as attribution is given to the Creator. The license allows for commercial use. If Reuser remixes, adapts, or builds upon the Project, Reuser must license the modified Project under identical terms.
- CC BY-NC 4.0: This license enables Reusers to distribute, remix, adapt, and build upon the project in any medium or format for noncommercial purposes only, and only so long as attribution is given to the Creator.
- CC BY-NC-SA 4.0: This license enables Reusers to distribute, remix, adapt, and build upon the project in any medium or format for noncommercial purposes only, and only so long as attribution is given to the Creator. If you remix, adapt, or build upon the material, you must license the modified project under identical terms.
- CC BY-ND 4.0: This license enables Reusers to copy and distribute the project in any medium or format in unadapted form only, and only so long as attribution is given to the creator. The license allows for commercial use.
- CC BY-NC-ND 4.0: This license enables Reusers to copy and distribute the project in any medium or format in unadapted form only, for noncommercial purposes only, and only so long as attribution is given to the creator.
- CC0 1.0: This license enables Reusers to distribute, remix, adapt, and build upon the project in any medium or format, with no conditions. The Creator waives all copyright and related or neighboring rights together with all associated claims and causes of action with respect to the Project to the extent possible under the law.
B. For Premium Projects (Commercial License)
For Premium Projects, the Creator grants the specific Purchasing User ("Licensee") a perpetual (subject to compliance), non-exclusive, non-transferable, non-sublicensable, worldwide license under the following strict terms:
Authorized Commercial Use (Physical Products Only)
Licensee may download and use the Project to physically produce items using digital fabrication tools. Licensee is permitted to sell, rent, or distribute these Physical Finished Products for profit.
- Small Business Limitation: This license covers the production and sale of up to 1,000 physical units per Project. For Mass Production (>1,000 units), Licensee must contact the Creator for an Extended Enterprise License.
Permitted Modifications for Fabrication
Licensee IS PERMITTED to modify the Project solely for technical compatibility and fabrication optimization (e.g., scaling, adjusting kerf/tolerance, combining with names/text, file format conversion).
Strict Prohibitions (What You Cannot Do)
- No Digital Resale: Licensee shall not share, sell, or distribute the Project or any Modified Digital Version (including G-code, sliced files, STL, or SVG) in any digital format.
- No "Print-on-Demand" (POD): Licensee shall not upload the Project to third-party automated manufacturing services (e.g., Shapeways, Redbubble) where the Project is stored accessible to third parties.
- No Molds for Resale: Licensee may not produce molds, casts, or stamps derived from the Project for the purpose of selling such tools to third parties.
- Single Seat License: This license is for one individual or one corporate workstation. Hosting the Project on a shared corporate server is prohibited.
Refunds & Revocation
- All sales are final due to the nature of digital goods. (Except in cases of infringement or technical defects as explicitly provided in Section 3, or where required by applicable law.)
- Atomm may revoke a license only if the Purchasing User materially violates this Agreement.
- Licenses already obtained by other users remain valid even if the Creator removes the Project from Atomm.
5. Restricted Use (Global)
Regardless of the license type, all Users are restricted from:
- Unlawful Use: Using Projects for pornographic, defamatory, unlawful purposes, or to promote violence/hatred.
- Trademark Use: Users may not use the Project (in whole or in part) as a trademark, logo, or service mark, nor register it as such.
- Competitive Restriction: User shall not access the Platform or use the Services for the purpose of building a similar or competitive website, product, or service.
- Anti-Scraping & AI Prohibition: User shall not engage in any automated use of the system, such as using scripts, bots, spiders, crawlers, or data mining tools to harvest, scrape, or download Projects, User profiles, or related metadata. Specifically, accessing the Platform’s content to train Artificial Intelligence (AI) models or Machine Learning algorithms without Atomm’s express written consent is strictly prohibited.
6. Enforcement and Anti-Abuse Measures
Atomm retains the right to:
- suspend, terminate, or restrict accounts violating this Agreement;
- remove infringing or improperly licensed Projects;
- disclose information required for legal enforcement;
- issue DMCA takedowns on behalf of Creators.
Purchasing Users acknowledge and agree that any unauthorized distribution of digital files constitutes copyright infringement, subject to statutory damages in multiple jurisdictions.
7. Disclaimer
The Platform does not mediate private copyright disputes.
Atomm may take action pursuant to its Terms of Service but does not guarantee resolution.
Creators and Purchasing Users are solely responsible for securing legal remedies.
8. Intellectual Property of the Platform
8.1 Atomm Ownership
The Platform’s visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Service ("Materials") provided by Atomm are protected by intellectual property and other laws. All Materials are the property of Atomm or its third-party licensors.
8.2 No Reverse Engineering
Unless explicitly permitted by law, you may not modify, create derivative works of, disassemble, decompile, or otherwise reverse engineer any aspect of the Platform or the Materials.
9. General Provisions
9.1 Severability
If any provision of this Copyright Statement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from this Agreement. The remaining provisions of this Copyright Statement shall remain in full force and effect.
9.2 Entire Agreement
This Copyright Statement, together with the Atomm Terms of Service, constitutes the entire agreement between you and Atomm regarding the use of the Projects and supersedes all prior or contemporaneous agreements, understandings, or representations, whether written or oral, regarding such subject matter (including but not limited to any prior versions of this Copyright Statement).
9.3 No Waiver
Atomm's failure to enforce any right or provision of this Copyright Statement will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Atomm.
10. Language
This Agreement is drafted in English.
In case of conflict between translations, the English version shall prevail.
